I am a CapCut Premium account holder. I have been thoroughly reviewing the user conditions, and I wanted to seek clarification regarding the usage of CapCut for commercial purposes.

As part of my work with a Content Agency, I plan to use CapCut for video editing to enhance our content creation process. However, I noticed in the user conditions that there are restrictions on using CapCut for commercial, advertising, marketing, or sales purposes.

Could you please provide more details on whether my intended use falls under these restrictions? I want to ensure that I am compliant with the terms of use and, if necessary, explore alternative solutions.

Thank you for your time and assistance. I appreciate your prompt response to help me better understand the scope of usage for CapCut.

Hi,

As a CapCut Premium account holder collaborating with a content agency, it's essential to understand the platform's terms regarding commercial use. CapCut's standard Terms of Service primarily grant a license for personal, non-commercial use of their services and content. However, CapCut for Business offers content labeled "Commercial use," which can be utilized for both commercial and non-commercial purposes without additional license fees, as outlined in Section 1 of the CapCut Materials License Agreement.

Important links in this regard are outlined below:

Given your intent to use CapCut for commercial video editing within your content agency, it's crucial to ensure that the materials and features you plan to use are designated for commercial use. If the content or tools you intend to utilize are not labeled for commercial use, their application in commercial projects may violate CapCut's terms.

  • While certain CapCut Materials may only be permitted for personal and non-commercial use and purposes, certain CapCut Materials may be used for limited commercial purposes in addition to personal and non-commercial use and purposes (“Dual Use Materials”).

  • Dual Use Materials will be made available with specific marks (e.g., “commercial use”, “commercial” marks) on the CapCut Platform.

To maintain compliance, consider exploring CapCut's business-oriented solutions, such as CapCut for Business or CapCut Commerce Pro. These platforms are tailored to meet commercial content creation needs and provide appropriate licensing for such purposes.

How This Might Apply to Your Content Agency Work:

  • Content creation for clients: If your content agency creates videos for clients who then use those videos for their own commercial, advertising, marketing, or sales purposes, this likely falls under the restricted commercial use category. Even though you are not directly selling CapCut, you are using it as a tool to produce content that will be used for commercial gain by your clients.
  • Internal marketing for your agency: Creating videos to promote your own content agency's services, attract clients, or for your agency's marketing materials would also be considered commercial use.
  • "Personal" vs. "Commercial" Use: The distinction often hinges on whether the video creation is directly tied to generating revenue or promoting a business entity. Using CapCut for personal, non-profit, or purely artistic projects is generally acceptable under free licenses.
  • Terms of service can sometimes be broadly worded. If the wording is ambiguous, it's always best to err on the side of caution and seek explicit clarification from CapCut (more on this below).

Recommendations and next steps:

  1. Review your CapCut Pro subscription terms: Click on the links given above and carefully review each term to see if the work you are intending to do falls in any of the category.
  2. Contact CapCut through email directly: In this forum we only give recommendations and possible solutions, however, you need to reach out to the team at [email protected] directly for definitive clarification on terms of usage.
  3. Explain your intended use case (content agency work, creating videos for commercial clients) and ask them to confirm whether your CapCut Pro subscription covers this type of commercial activity.
  4. Explore CapCut for business or Commerce PRO: The specific Business or Commerce licenses are explicitly designed for commercial use. Inquire with CapCut support if these options provide for clearer commercial usage rights if your Pro subscription doesn't fully cover your needs.

In summary, while CapCut Premium offers robust features, its standard terms are geared towards personal use. For commercial applications, it is advisable to utilize content explicitly labeled for commercial use or opt for CapCut's business-specific services to ensure adherence to the terms and conditions.
